Privacy Policy + Terms & Conditions Agreement

This Privacy Policy and Terms & Conditions (“Agreement”) explains how Boss Me Up Services LLC (“Boss Me Up,” “we,” “us,” “our”) collects, uses, and protects information, and the terms that govern your use of our website, CRM systems, automations, community portals, templates, and services (collectively, the “Services”). By using our Services or signing below, you agree to this Agreement.

1) Privacy Policy

1.1 Information We Collect

  • Contact details: name, email, phone number, business name, and communication preferences.
  • Project details: information you submit in forms, onboarding questionnaires, intake forms, or support requests.
  • Billing data: invoice details and payment confirmations (we do not store full card numbers if processed via third parties).
  • Usage data: device/browser details, pages viewed, link clicks, form submissions, and general analytics.
  • Files/content you provide: images, copy, branding assets, documents, and other materials you upload or share.

1.2 How We Use Your Information

  • To deliver and improve Services (websites, funnels, CRM builds, automations, templates, portals, and support).
  • To communicate about onboarding, updates, billing, service notices, and support requests.
  • To send marketing messages only when permitted by law and/or your consent (you can opt out at any time).
  • To protect against fraud, unauthorized access, and misuse, and to comply with legal obligations.

1.3 Sharing of Information

We do not sell your personal information. We may share information:

  • With service providers that help us operate (hosting, CRM platforms, analytics, payment processors, email/SMS providers).
  • For legal reasons if required by law, court order, or to protect rights/safety of our clients and business.
  • With your consent or at your direction (e.g., when granting access to third-party vendors).

1.4 Data Security

We use reasonable administrative, technical, and physical safeguards to protect information. No method of transmission or storage is 100% secure, so we cannot guarantee absolute security. You are responsible for keeping your login credentials confidential and for any activity under your account.

1.5 Data Retention

We retain information as long as needed to provide Services, maintain records, comply with legal obligations, resolve disputes, and enforce agreements. You may request deletion of certain data, subject to legal and operational requirements.

1.6 Cookies & Tracking

We may use cookies, pixels, and similar technologies for basic site functionality, analytics, and performance. You can control cookies through your browser settings. Disabling cookies may affect certain features.

1.7 Your Rights

  • Request access, correction, or deletion of certain personal information.
  • Opt out of marketing emails or texts at any time (see Consent & Communication).
  • Request a copy of information you provided, where feasible.

1.8 Children

Our Services are not directed to children under 13. We do not knowingly collect personal information from children under 13.

2) Terms & Conditions

2.1 Services & Scope

Boss Me Up provides digital services such as web design, CRM build-outs, automation setup, funnels, templates, community portals, integrations, and related consulting. Specific deliverables, timelines, pricing, and scope are defined in your proposal, invoice, statement of work, or written agreement (collectively, “Order”). If an Order conflicts with this Agreement, the Order governs for that project.

2.2 Client Responsibilities

  • Provide accurate information, timely feedback, and required access (domains, hosting, CRM, social accounts, etc.).
  • Ensure you have rights to use any content you supply (logos, photos, copy, music, trademarks).
  • Review all deliverables for accuracy, compliance, and suitability before publishing or launching.

2.3 Payments, Fees & Billing

  • Fees are due as stated on your invoice/Order. Late payments may pause work and/or disable access to hosted assets/CRM until paid.
  • Third-party fees (CRM subscriptions, email/SMS fees, hosting, domains, plugins, AI tools, etc.) are your responsibility unless explicitly included.
  • Setup fees and deposits are generally non-refundable once work begins, unless required by law or stated otherwise in writing.

2.4 Revisions & Change Requests

Reasonable revisions may be included as stated in your Order. Any request outside the original scope may require a change order and additional fees. Delays caused by missing content/approvals may impact timelines.

2.5 Intellectual Property

  • Your Materials: You retain ownership of content and assets you provide.
  • Our Materials: Boss Me Up retains ownership of our pre-existing tools, templates, processes, and know-how.
  • Project Deliverables: Upon full payment, you receive a license to use the deliverables created for you, unless otherwise stated in your Order.

2.6 No Legal/Tax/Financial Advice

Boss Me Up provides digital strategy and implementation services and does not provide legal, tax, accounting, or financial advice. You are responsible for consulting qualified professionals regarding compliance, advertising claims, disclosures, and regulations applicable to your business.

2.7 Availability, Uptime & Third-Party Platforms

We may integrate or build on third-party platforms (e.g., CRMs, email/SMS providers, hosting). We are not responsible for outages, policy changes, rate changes, platform limitations, or service interruptions caused by third parties. Any uptime commitments must be stated in writing.

2.8 Warranty Disclaimer

Services are provided “as is” and “as available.” We make no guarantees that Services will be uninterrupted, error-free, or that any specific business outcome (sales, leads, rankings, revenue) will be achieved.

2.9 Limitation of Liability

To the maximum extent allowed by law, Boss Me Up will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits/revenue/data, arising from or related to the Services. Our total liability for any claim will not exceed the amount you paid to Boss Me Up for the Services giving rise to the claim in the 3 months prior to the event.

2.10 Termination

Either party may terminate an Order in writing. Upon termination, you remain responsible for fees incurred and work completed through the termination date. We may suspend Services for nonpayment, misuse, or policy violations.

2.11 Dispute Resolution

If a dispute arises, parties agree to attempt good-faith resolution first. If unresolved, disputes may be handled through mediation or arbitration, as permitted by law, or in a court of competent jurisdiction, depending on the Order and applicable law.

2.12 Governing Law

This Agreement is governed by the laws of the state/jurisdiction where Boss Me Up Services LLC is registered, unless your Order states otherwise.

2.13 Updates to This Agreement

We may update this Agreement from time to time. The “Effective Date” reflects the latest version. Continued use of Services after updates means you accept the revised terms.

By providing your email and/or phone number, you consent to receive service-related communications (e.g., onboarding, reminders, updates, invoices). Marketing messages may be sent only when permitted by law and/or with your consent.

  • Email Opt-Out: Use the unsubscribe link (if present) or email us to opt out of marketing emails. Service messages may still be sent.
  • SMS Opt-Out: Reply STOP to opt out of marketing text messages. Message/data rates may apply. Frequency varies.

4) Agreement & Signature

By signing below, you acknowledge that you have read and agree to the Privacy Policy and Terms & Conditions above.
